FACTS ABOUT ZONING AND ENGINEERING

 

 

Permits of some type are generally required for work in and around your property. Always call the Zoning Officer before planning or starting any project. Do not spend a lot of money with a design professional until you know for sure that the project complies with Mendham Borough Zoning Ordinances.

Ordinances do change, what was permitted last month may be prohibited or different this month. Check with Zoning.

 

Residents of Mendham Commons generally need approval from the Homeowners Association. These should be in place prior to seeking municipal approvals.
 

 Setbacks from property lines and other structures vary from one zoning district to another. Always check for the requirements in your zone.
 

 Pools - including decks, patios, filters, heaters, pumps, et al must meet lot coverage and setback requirements. All pools require a permit.

 

Fences & Walls, to include entrance pillars. Zoning must approve gates before construction, and a permit is required.

  

Tree cutting, within limits, is permitted, and may require a permit. Consult with Zoning about this.

 

Garden sheds need zoning approval even if the size does not require a building permit. Note! that there are height and setback restrictions. Consult Zoning for details.  

 

Patios & Walkways need zoning approval.

  

Noise from power equipment is allowed between 8am-8pm weekdays, and 9am-8pm weekends.

 

Types of signs vary in size, depending on the zoning district; most require permits. Contact Zoning for particulars.

Temporary signs are allowed by permit only

 

Political Signs do not require permits. They may be placed 30 days prior to Election Day, and are to be removed 7 days after Election Day.

 

Flagpoles require a permit - height and location on the property are covered by the zoning code.

  

Mendham Borough Historic District has special zoning requirements.

   

Vehicles  'For Sale'  cannot be parked in the front yard of any property except in the driveway. 

 

OUTSIDE DISPLAYS are prohibited except for the dates specified in the Borough ordinance. Check with the zoning officer. 

 

 

 

 

 

 

 

The Borough Engineer is required to review and approve the following:

 

Soil Disturbance of an area 2,500 square feet or over requires a review by the Borough Engineer. A permit is required.

 

An increase in impervious coverage of 1,000 square feet or more will require Stormwater Management provisions, such as a dry well. A permit is required

 

Construction is restricted on wetlands, stream corridors, all easements, and flood plains, also on slopes over 15%.

 

Driveways need a Driveway Opening Permit from the Borough Engineer, and sometimes a zoning permit.
