65-10 Possession and Consumption By Underage Persons prohibited
It shall be unlawful for any person under the legal age to, without legal authority, knowingly possess or knowingly consume an alcoholic beverage on private property, except as provided for in § 65-13 below.
65-13 Exceptions
A. Nothing contained in this article is intended, nor shall it be construed, as prohibiting an underaged person from consuming or possessing an alcoholic beverage in connection with a religious observance, ceremony or rite, or consuming or possessing an alcoholic beverage in the presence of and with the permission of a parent, guardian or relative who has attained the legal age to purchase and consume alcoholic beverages; provided that, if the underaged person is found to possess or consume an alcoholic beverage in the presence of and with the permission of a relative other than a parent or guardian, the police shall notify the parent or legal guardian, by certified mail, of the incident together with the name of the relative who gave permission for the possession or consumption of the alcoholic beverage by the underaged person. The notification shall include a request that the parent or guardian acknowledge and return a copy of the letter to the Police Department within 15 days of receipt.
B. As used in the preceding Subsection A, the following terms shall have the meanings set forth:
- GUARDIAN
- A person who has qualified as a guardian of the underaged person pursuant to testamentary or court appointment.
- RELATIVE
- The underaged person's grandparent, aunt or uncle, sibling, or any other persons related by blood or affinity.
C. Nothing contained in this article is intended nor shall it be construed as prohibiting possession of alcoholic beverages by any such person while actually engaged in the performance of employment by a person who is licensed under Title 33 of the Revised Statutes, or while actively engaged in the preparation of food while enrolled in a culinary arts or hotel management program at a county vocational school or post-secondary educational institution; provided, however, that this article shall not be construed to preclude the imposition of a penalty under this article, N.J.S.A. 33:1-81, or any other section of law against a person who is convicted of unlawful alcoholic beverage activity on or at premises licensed for the sale of alcoholic beverages.
73-2 Pet Registration
Any person or persons who shall own, keep or harbor any dog or dogs, male or female, over the age of seven months shall register and number the same with the Clerk of the borough.
73-11 Barking or Crying Dogs

No person shall keep, harbor or maintain a dog or dogs which bark or cry with such frequency or duration and at such times of the day or night as to disturb the peace and quiet of the neighborhood
73-27 Statement of Purpose
The Mayor and Council of the Borough of Mendham are concerned with the negative impacts of white-tailed deer and have found that the increase in the white-tailed deer population causes a public health nuisance which is inimical to the health and general welfare of the public. The borough has, therefore, established a Deer Management Program pursuant to an agreement with the State of New Jersey, Division of Fish, Game and Wildlife, which includes culling of the deer population by authorized agents of the borough, promotion of hunting as regulated by the State of New Jersey and live trapping and transfer of white-tailed deer. It is the purpose of this article to prevent such conduct which would interfere with the Deer Management Program established by the Borough and which may attract white-tailed deer to properties in the Borough.
73-28 White-tailed deer feeding prohibited.
A. No person shall feed, cause to be fed or provide food for white-tailed deer anywhere in the borough, either on public or private property.
B. Exceptions. This section shall not be construed to prohibit feeding of white-tailed deer by authorized agents of the borough in conjunction with the borough's Deer Management Program or when otherwise permitted by the rules and regulations of the Division of Fish, Game and Wildlife of the State of New Jersey. 73-29 Interference with Deer Management Program and agents.
A. No person shall conduct himself or herself in a manner that interferes or has the effect of interfering with any authorized agent of the borough conducting deer management activities. All authorized agents of the borough shall carry with them identification from the borough authorizing them to conduct deer management activities on behalf of the borough.
B. No person shall interfere with, vandalize, damage or disable any pen, trap or other device or equipment which is part of the borough's Deer Management Program.
C. No person shall enter or occupy any park or other property, public or private, that has been closed to the public for purposes of conducting the Deer Management Program. 147-9 Construction Activities and Power Equipment
147-9 Construction Ordinance

A. Definitions. As used in this section, the following terms shall have the meanings indicated:
- CONSTRUCTION ACTIVITIES
- Includes excavation, earthmoving, demolition, construction, repair and/or alteration and shall also include deliveries and/or pickups relative to any of the above.
- POWER EQUIPMENT
- Includes equipment which uses electric, gasoline or a source of power other than manual and shall specifically include a power saw, hammer, sander, drill, grinder, lawn mower, leaf blower, woodchipper, thatcher, generator, air compressor, etc.
B. Hours of construction activities or use of power equipment. No construction activities or use of power equipment shall take place at any time other than the following:
(1) On weekdays (Monday through Saturday) between the hours of 7:00 a.m. and 6:00 p.m.
(2) Sundays and holidays. No construction activities or use of power equipment shall be permitted on Sundays or on New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.
(3) Exceptions.
(a) Construction activities or use of power equipment by a property owner on his own property, provided that such activity is not carried on for profit or livelihood and is not performed by a paid contractor, may be carried on any day between the hours of 7:00 a.m. and 9:00 p.m.
(b) In case of emergency or in the interest of public health or safety, the Construction Official may grant a permit for construction activities or use of power equipment for a period not to exceed three days, subject to renewal for periods of three days or less, during hours otherwise prohibited by this section, as the Construction Official shall determine are necessary.
(c) If the Construction Official determines that the public health, safety and welfare will not be impaired by construction activities or use of power equipment relative to any building or the excavation of streets and highways during hours otherwise prohibited by this section, and if he shall further determine that substantial loss or inconvenience would be suffered by any party if the ability to engage in such activities was denied, he may grant permission for such work to be done during hours otherwise prohibited by this section upon application being made at the time the permit for said work is awarded or during the progress of the work.
(d) Activities confined within a wholly enclosed building or structure.
(e) Activities necessary to prevent injury to persons or property, including snow removal.
(f) Activities conducted by or for any government unit or agency.
(g) The operation of a generator during a power failure.
(h) The operation of a farm as permitted under the Right to Farm Act (N.J.S.A. 4:1C-1 et seq.).
C. Enforcement. The provisions of this section shall be enforced by the Borough Police and the Construction Official.
D. Any person violating any of the provisions of this section shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code, in the discretion of the judge.

No person shall make, continue or cause or allow to be made or continued any unnecessary or unusual sound or noise which either annoys, injures or endangers the comfort, repose, health or safety of others, unless the making and continuing of the same is necessary for the protection or preservation of property or the health, safety, life or limb of some person or persons.
206-5 Parking prohibited at all times; night parking.
A. No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I, § 206-43, attached to and made a part of this chapter.
B. No person shall park a vehicle upon any street or road in the borough at any time between the hours of 2:00 a.m. and 6:00 a.m., prevailing time, during the period of November 1 through April 15.
