Notice is hereby given that sealed bids will be received by the Borough Administrator of the Borough of Mendham (or her designee), County of Morris, State of New Jersey, on Tuesday, August 3, 2021 at 11:00 a.m., prevailing time, or as soon thereafter as the matter may be heard, in the Phoenix House, 2 West Main Street, in the Borough of Mendham, Morris County, New Jersey, at which time and place sealed bids will be publicly opened and read aloud.  The contract will run for three years commencing on October 1, 2021 for:

 

PUMPING, HAULING AND DISPOSAL OF SLUDGE

FROM THE MENDHAM BOROUGH SEWAGE TREATMENT PLANT

 

Domestic sewage sludge, dewatered to a consistency not to exceed 7% solids by weight, shall be removed from the Mendham Borough Sewage Treatment Plant and transported to the Passaic Valley Sewerage Commission at its Treatment Plant, 600 Wilson Avenue, Newark, New Jersey 07105.

 

The Instructions to Bidders, Detailed Specifications, Proposal, form of Contract, and other documents may be obtained from the Borough Administrator, daily Monday through Friday between the hours of 9:00 a.m. and 4:00 p.m. until 4:00 p.m. on Monday, August 2, 2021, after which no Instructions to Bidders, Detailed Specifications, forms of Proposal, or other documents will be issued.

 

            Proposals shall be enclosed in opaque sealed envelopes, plainly marked “Proposal For Pumping, Hauling and Disposal of Sludge from the Mendham Borough Sewage Treatment Plant” and shall show the name and address of the bidder on the outside.  Due to uncertainty regarding changing COVID-19 social distancing requirements during this time period, bidders are strongly encouraged to submit bids via certified mail or express delivery service.  In the alternative, proposals may be deposited in a drop box located on the front porch of the Phoenix House, 2 West Main Street, Mendham, NJ 07945 on the date set for receipt of bids.  If mailed or sent via express delivery service, the sealed envelope containing the bid and marked as directed above must be enclosed in another envelope addressed for mailing as follows:  Mendham Borough Administrator, The Phoenix House, 2 West Main Street, Mendham, New Jersey 07945.

 

              Bidders wishing to attend the bid opening will be required to comply with all Borough of Mendham and State of New Jersey mask and social distancing requirements in place at that time.

 

Owner will not assume responsibility for bids forwarded through the mail or express delivery service if lost in transit at any time before bid opening.  Bids received after the time set forth above will be returned unopened.

 

            No proposal will be considered unless accompanied by bid security in the amount of ten percent (10%) of the bid, but not more than $20,000, in the form of a certified check, cashier's check or bid bond, binding the bidder to execute a contract within ten (10) days after notification of acceptance of bid.

 

The successful bidder will be required to furnish a bond for the faithful performance of the contract in a sum not less than 100% of the total price for the project, said bond to be that of an approved surety company authorized to do business in the State of New Jersey, and acceptable to the Borough.  No proposal will be considered unless accompanied by a Consent of Surety from a surety company binding it to provide and issue the required performance bond.

 

            Owner reserves the right to waive minor or inconsequential discrepancies and technical omissions in any proposal, and to reject any and all proposals in accordance with N.J.S.A 40A:11-13.2.  Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq.  The Borough of Mendham reserves the right to extend the contract upon agreement between the Borough and the contractor in accordance with N.J.S.A. 40A:11-15.

 

 

            Affirmative Action documentation must be supplied to Owner after notification of Owner’s intent to award and prior to execution of contract.  If the contractor fails to timely supply owner with the necessary Affirmative Action documentation, Owner may declare the proposal unresponsive and award the contract to another contractor.

            Contractors submitting bids are required to comply with N.J.S.A. 52:32-44 (Proof of Business Registration) and provide other required forms as more specifically set forth in the specifications.
